Terms of Service

Welcome to Divyana. These Terms of Service (“Terms”) govern your use of the Divyana mobile application (“App”) operated by Divyana Inc. (“Divyana,” “we,” “us,” or “our”). By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By downloading, installing, or using Divyana, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and Divyana Inc. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


2. Description of Service

Divyana is a True Human Intelligence system — a Life Operating System designed to help you tap into consciousness by adapting to your mind, body, surroundings, nature, and planetary chart. The App synthesizes health data, astrological insights, environmental context, and personal journaling into a daily readiness signal (the “Divyana Score”) and personalized guidance across four pillars: Spirit, Body, Mind, and World.

Features include health metric tracking via Apple Health, astrological chart generation, AI-powered journaling and dream analysis, your personal Divyana AI chat, goal tracking, and environmental context.


3. Eligibility and Account Responsibilities

3.1 Age Requirements

  • You must be at least 13 years old to use Divyana
  • Users between 13 and 17 years of age must have parental or guardian consent
  • We do not knowingly permit children under 13 to create accounts (see Section 16)

3.2 Account Accuracy

  • You must provide accurate, current, and complete information when creating your account
  • You are responsible for maintaining the accuracy of your account information

3.3 Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activity that occurs under your account
  • Notify us immediately at support@divyana.ai if you suspect unauthorized access to your account

4. Subscriptions and In-App Purchases

4.1 Subscription Tiers

Divyana offers the following service tiers:

  • Seeker (Free): Core app access, including your daily Divyana Score, core pillar readings, and up to 50 AI chat conversations for the lifetime of the account.
  • Mystic: Expanded access including up to 300 AI chat conversations per month and deeper pattern analysis across your pillars. Available as monthly or annual subscription.
  • Sovereign: Full access including up to 800 AI chat conversations per month, compatibility readings, and the full Divyana experience. Available as monthly or annual subscription.

Current pricing is displayed within the App at the time of purchase. Conversation and feature allowances may be adjusted from time to time to reflect evolving capacity, cost, and fair-use considerations; any material changes will be communicated in accordance with Section 4.6. Prices may vary by region and are subject to change with notice.

4.2 Billing and Auto-Renewal

  • Subscriptions are billed through your Apple ID via the App Store
  • Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled at least 24 hours before the renewal date
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscription at any time through your Apple ID account settings: iOS Settings > [Your Name] > Subscriptions

4.3 Cancellation

  • Cancelling a subscription stops future renewals but does not provide a refund for the current billing period
  • You retain access to paid features through the end of the current billing period
  • To cancel, go to iOS Settings > [Your Name] > Subscriptions > Divyana > Cancel Subscription

4.4 Refunds

  • All purchases are processed by Apple. Refund requests must be submitted to Apple directly at reportaproblem.apple.com
  • Divyana Inc. does not process refunds for App Store purchases

4.5 Free Trials

  • If a free trial is offered, it begins immediately upon subscription initiation
  • You will not be charged during the free trial period
  • If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate
  • Only one free trial per Apple ID

4.6 Price Changes

  • We will provide reasonable notice of price changes before they take effect
  • Your continued use of a subscription after a price change constitutes acceptance of the new price

5. Health & Insight Disclaimer

Divyana is not a medical device, medical service, or healthcare provider, and does not provide medical advice, diagnosis, or treatment.

  • The Divyana Score, health metrics, body battery, and life intelligence insights are for personal exploration only — not clinical assessments.
  • Jyotisha-based features (natal charts, Fortune timing, planetary insights) are computed from classical Vedic systems for personal reflection. They are not a substitute for professional medical, mental health, financial, or legal advice.
  • AI-generated reflections, dream interpretations, and conversations are not therapeutic or clinical services.
  • Always consult a qualified professional before changing your health, fitness, or wellness regimen.
  • In an emergency, call 911 (or your local emergency number) immediately. Divyana does not monitor for, or alert, emergency services.

6. Voice Journaling

By using voice journaling, you consent to recording through your device's microphone, transmission to our AI service providers for transcription and analysis, and storage of the transcribed text and AI-generated reflections in your account. You may use text-based journaling instead at any time.


7. AI Features

Your personal Divyana AI and other AI features are provided “as is” and may occasionally produce inaccurate or unexpected responses. They are not a substitute for professional medical, mental health, financial, or legal advice. Conversation limits apply per subscription tier (see Section 4.1): Mystic and Sovereign limits reset monthly; the Seeker lifetime allowance does not reset. We may moderate or limit access in cases of misuse. Do not input sensitive personal information (financial accounts, government IDs, passwords) into AI chat.


8. Acceptable Use

You agree to use Divyana only for lawful, personal purposes. You will not:

  • Harm, harass, threaten, or infringe on the rights of others
  • Reverse-engineer, decompile, or extract source code from the App
  • Share, transfer, or sell your account credentials
  • Use bots, scripts, or automated tools to access or scrape the App
  • Attempt unauthorized access to any part of the service or its infrastructure
  • Circumvent subscription restrictions or unlock paid features without payment
  • Upload or transmit malicious code, viruses, or harmful content
  • Use the App in any way that violates applicable law

9. User-Generated Content & Community Standards

Some Divyana features show your content to other users — direct messages with friends, circle energy sends, the metadata of circles you create, and your public profile (display name, avatar). We have zero tolerance for objectionable content and abusive users.

9.1 Prohibited content

  • Harassment, threats, or intimidation
  • Hate speech targeting identity (race, religion, gender, sexual orientation, disability, or other protected characteristics)
  • Sexually explicit content; anything that sexualizes or endangers minors
  • Violence, threats of violence, or content that glorifies it
  • Content that promotes self-harm or suicide
  • Spam, scams, or malicious links
  • Anything unlawful, fraudulent, or that violates the rights of others

9.2 Filtering, reporting, blocking

  • Pre-send filter: messages may be screened against a moderation policy before they are delivered.
  • Report: long-press any message or use the menu on a profile to flag it for review.
  • Block: removes the user's content from your feeds instantly and notifies our moderation team.

9.3 Our response — 24-hour SLA

We act on objectionable content reports within 24 hours. Possible actions include removing the content, warning the user, restricting features, or banning the account. Repeat offenders are banned. Severe violations — child safety, threats of violence, or coordinated abuse — may result in immediate termination without prior notice or appeal, and we may preserve relevant data for law enforcement.


10. Intellectual Property

Divyana's name, logo, design, content, and functionality are owned by Divyana Inc. and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. You retain full ownership of content you create (journal entries, voice recordings, feedback) and grant us a worldwide, royalty-free license to process, store, and use it to deliver and improve Divyana, including improving our models, scoring, and product quality. Where feasible, content used for model and product improvement is first de-identified or aggregated. Third-party AI providers we use (Anthropic, OpenAI) do not use your content to train their own models. We never sell your content or share it for advertising.


11. Apple Licensed Application End User License Agreement

The App is made available through the Apple App Store. To the extent these Terms are less restrictive than Apple's standard Licensed Application End User License Agreement (LAEULA), the LAEULA terms prevail. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms.


12. Data & Privacy

Your use of Divyana is governed by our Privacy Policy. You retain ownership of your data, can request deletion at any time, your data is never sold, and Apple HealthKit data is never used for advertising.


13. Limitation of Liability

Divyana is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted or error-free, and we do not guarantee specific health, intelligence, or life outcomes. To the maximum extent permitted by law, Divyana Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability for any claim shall not exceed the greater of (a) the amount you paid Divyana in the 12 months preceding the claim or (b) $100.


14. Indemnification

You agree to indemnify and hold harmless Divyana Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App in violation of these Terms, your violation of third-party rights, or your violation of applicable law.


15. Termination

You may delete your account at any time from Profile > Delete Account. We may suspend or terminate access for violation of these Terms or for conduct harmful to other users. Upon termination, your license ends immediately and your data is handled in accordance with our Privacy Policy. Sections 5, 9, 10, 12, 13, 14, 16, 17, 18, and 20 survive termination.


16. Children's Privacy (COPPA)

Divyana is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Users between 13 and 17 may use the App only with the consent of a parent or legal guardian; by permitting a minor to use Divyana, you agree to these Terms on their behalf. If you believe a child under 13 has created an account, contact support@divyana.ai.


17. Dispute Resolution & Arbitration

17.1 Informal Resolution

Before any formal proceeding, contact support@divyana.ai. We will attempt to resolve the dispute within 30 days.

17.2 Binding Arbitration

If informal resolution fails, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as stated below.

17.3 Class Action & Jury Waiver

Disputes will be conducted only on an individual basis, not as a class, consolidated, or representative action. You and Divyana waive any right to a jury trial. Nothing in this Section limits any right that cannot be waived under applicable law.

17.4 Exceptions

Either party may seek emergency injunctive relief in court to prevent irreparable harm pending arbitration.


18. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Subject to Section 17, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any disputes not subject to arbitration.


19. Changes to Terms

We may update these Terms. Material changes will be announced through the App or by email at least 30 days before they take effect. Continued use after changes constitutes acceptance.


20. Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and Divyana Inc. If any provision is unenforceable, the rest remain in full force. Our failure to enforce a right does not waive it. You may not assign these Terms without our written consent; we may assign freely. We are not liable for delays caused by circumstances beyond our reasonable control.
