Welcome to Divyana. These Terms of Service ("Terms") govern your use of the Divyana mobile application ("App") operated by Divyana Inc. ("Divyana," "we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By downloading, installing, or using Divyana, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and Divyana Inc. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Divyana is a personal wellness application that synthesizes health data, astrological insights, environmental context, and personal journaling into a daily readiness score (the "Oracle Score") and personalized recommendations. The App is designed for personal growth, self-awareness, and self-discovery across four pillars: Body, Spirit, Mind, and World.

Features include health metric tracking via Apple Health, astrological chart generation, AI-powered journaling and dream analysis, Oracle Chat (an AI conversation partner), goal tracking, and environmental wellness context.

3. Eligibility and Account Responsibilities

3.1 Age Requirements

• You must be at least 13 years old to use Divyana
• Users between 13 and 17 years of age must have parental or guardian consent
• We do not knowingly permit children under 13 to create accounts (see Section 15)

3.2 Account Accuracy

• You must provide accurate, current, and complete information when creating your account
• You are responsible for maintaining the accuracy of your account information

3.3 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• Notify us immediately at support@divyana.ai if you suspect unauthorized access to your account

4. Subscriptions and In-App Purchases

4.1 Subscription Tiers

Divyana offers the following service tiers:

• Seeker (Free): Core app access with limited Oracle conversations and base features
• Mystic: Enhanced access including 50 daily Oracle conversations, additional Life Areas, and Dream Analysis. Available as monthly or annual subscription.
• Sovereign: Full premium access including unlimited Oracle conversations, all Life Areas, and all premium features. Available as monthly or annual subscription.

Current pricing is displayed within the App at the time of purchase. Prices may vary by region and are subject to change with notice.

4.2 Billing and Auto-Renewal

• Subscriptions are billed through your Apple ID via the App Store
• Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled at least 24 hours before the renewal date
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription at any time through your Apple ID account settings: iOS Settings > [Your Name] > Subscriptions

4.3 Cancellation

• Cancelling a subscription stops future renewals but does not provide a refund for the current billing period
• You retain access to paid features through the end of the current billing period
• To cancel, go to iOS Settings > [Your Name] > Subscriptions > Divyana > Cancel Subscription

4.4 Refunds

• All purchases are processed by Apple. Refund requests must be submitted to Apple directly at reportaproblem.apple.com
• Divyana Inc. does not process refunds for App Store purchases

4.5 Free Trials

• If a free trial is offered, it begins immediately upon subscription initiation
• You will not be charged during the free trial period
• If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate
• Only one free trial per Apple ID

4.6 Price Changes

• We will provide reasonable notice of price changes before they take effect
• Your continued use of a subscription after a price change constitutes acceptance of the new price

5. Health and Wellness Disclaimer

IMPORTANT: Divyana is not a medical device, medical service, or healthcare provider, and does not provide medical advice, diagnosis, or treatment.

• The Oracle Score, health metrics, body battery, wellness insights, and recommendations are for informational and personal exploration purposes only — they are not clinical assessments
• Astrological and esoteric features (natal charts, Fortune timing, planetary insights) are based on traditional systems; they are not scientifically validated predictions and should not be used as the basis for life decisions
• AI-generated journal reflections, dream interpretations, and Oracle Chat responses are not therapeutic or clinical services
• Always consult a qualified healthcare professional before making any medical decisions or changes to your health, fitness, or wellness regimen
• Do not rely on Divyana in emergency situations. If you are experiencing a medical emergency, call 911 (or your local emergency number) immediately
• Do not delay seeking medical attention based on information or insights provided by the App
• Divyana does not monitor for medical emergencies and cannot alert emergency services on your behalf

6. Voice Recording and Audio Processing

By using the voice journaling feature, you consent to:

• The recording of your voice through your device's microphone
• The transmission of audio recordings to our AI service providers for transcription and analysis
• The storage of transcribed text and AI-generated reflections in your account
• You may use text-based journaling at any time if you prefer not to use voice recording

7. Oracle Chat and AI Features

• Oracle Chat and AI-powered features are provided "as is" and may occasionally produce inaccurate, incomplete, or unexpected responses
• AI responses are not a substitute for professional advice (medical, psychological, financial, legal, or otherwise)
• Message limits apply per subscription tier and reset daily
• We reserve the right to moderate, limit, or suspend access to AI features in cases of misuse or abuse
• Do not input sensitive personal information (such as financial account numbers, government IDs, or passwords) into Oracle Chat

8. Acceptable Use

You agree to use Divyana only for lawful, personal purposes. You agree not to:

• Use the App to harm, harass, threaten, or infringe on the rights of others
• Attempt to reverse-engineer, decompile, disassemble, or extract source code from the App
• Share, transfer, or sell your account credentials to any third party
• Use automated tools, bots, or scripts to access or scrape the App
• Attempt to gain unauthorized access to any portion of the App or its infrastructure
• Use the App in any way that violates applicable law or regulation
• Circumvent subscription restrictions or attempt to unlock paid features without payment
• Upload or transmit malicious code, viruses, or harmful content

9. Intellectual Property

• Divyana, its name, logo, design, content, features, and functionality are owned by Divyana Inc. and are protected by copyright, trademark, and other intellectual property laws
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms
• You retain full ownership of content you create within the App (journal entries, voice recordings, feedback)
• By using the App, you grant Divyana Inc. a limited, worldwide, royalty-free license to process, store, and use your content solely for the purpose of delivering and improving the service to you
• Your content is never used to train AI models or shared with third parties for their commercial benefit

10. Apple Licensed Application End User License Agreement

The App is made available through the Apple App Store. To the extent these Terms are less restrictive than Apple's standard Licensed Application End User License Agreement (LAEULA), the LAEULA terms prevail. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support services for the App. Apple is a third-party beneficiary of these Terms.

11. Data and Privacy

Your use of Divyana is governed by our Privacy Policy, available at https://divyana.ai/privacy-policy and within the App. Key commitments:

• You retain ownership of your personal data
• You can request deletion of all your data at any time
• We do not sell your personal data
• Apple HealthKit data is never used for advertising

12. Limitation of Liability

• Divyana is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
• We do not guarantee specific health, wellness, or life outcomes from use of the App or its features
• To the maximum extent permitted by applicable law, Divyana Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App
• Our total liability to you for any claims arising from these Terms or the App shall not exceed the amount you paid to Divyana in the 12 months preceding the claim, or $100, whichever is greater

13. Indemnification

You agree to indemnify, defend, and hold harmless Divyana Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the App in violation of these Terms; (b) your violation of any third-party rights; or (c) your violation of any applicable law.

14. Termination

• You may delete your account at any time from Profile > Delete Account within the App
• We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms or for any conduct we determine to be harmful to other users or to Divyana
• Upon termination, your license to use the App ends immediately
• All data will be handled in accordance with our Privacy Policy upon account deletion or termination
• Sections 5, 9, 12, 13, 16, and 17 survive termination of these Terms

15. Children's Privacy (COPPA)

Divyana is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that a user is under 13, we will promptly delete their account and associated data. If you are a parent or guardian and believe your child under 13 has created an account, contact us at support@divyana.ai.

16. Dispute Resolution and Arbitration

16.1 Informal Resolution

Before filing any formal legal proceeding, you agree to attempt to resolve the dispute informally by contacting us at support@divyana.ai. We will attempt to resolve the dispute within 30 days.

16.2 Binding Arbitration

If informal resolution fails, any dispute arising from these Terms or your use of the App shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as otherwise stated herein.

16.3 Class Action Waiver

You and Divyana agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you and Divyana waive any right to a jury trial.

16.4 Exceptions

Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Subject to the arbitration clause above, you consent to the exclusive jurisdiction of the state and federal courts located in California for any disputes not subject to arbitration.

18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email at least 30 days before the change takes effect. Your continued use of the App after changes constitutes acceptance of the revised Terms. The "Last Updated" date at the top reflects the most recent revision.

19. Miscellaneous

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Divyana Inc. regarding the App
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force
• No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights freely
• Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control
